WHOIS
The public Internet is elemental to an economy that works for people and one that is fit for the digital age. The domain name system enables the Internet to operate as the fundamental resource that it is today. However, domain names can also be used for various online abuses. Ensuring the accuracy of, and lawful access to, domain name registration data is critical for stopping these misuses, holding bad actors accountable, and protecting parties impacted by domain misuse.
In May of 2018, ICANN adopted its Temporary Specification for gTLD Registration Data to bring the public WHOIS into compliance with the General Data Protection Regulation and solicited feedback on its proposal for a unified access model. They also convened a Technical Study Group and initiated an Expedited Policy Development Process working group to provide recommendations for a Standardized System of Access and Disclosure (SSAD) for non-public registrant data for gTLD’s.
While ICANN’s multi-year process produced various recommendations for an SSAD, without an operational system data protection authorities, the European Data Protection Board, and others would be severely limited in their ability to provide actionable guidance on the application of data protection laws like the GDPR to SSAD.
In addition to our active participation in ICANN’s policy development process, we conducted extensive outreach within the ICANN community to develop a viable, and operational, trusted ecosystem for managing access to WHOIS data. We actively participated in ICANN’s policy development process, and engaged in extensive outreach to solicit feedback and better understand the concerns of all Internet stakeholders. From this, we developed a holistic approach to the processing of domain name registration data to better address domain abuse as well as data privacy concerns, and a platform for managing a trusted ecosystem for requesting access to this data.
